Family law

A separation is rarely settled well in a hurry. We look for an agreement first and prepare for trial only when it becomes unavoidable.

Before you move out

Leaving the family home without a written agreement or a court decision weakens your position on custody and on who keeps the home. Call us before you pack, not afterwards.

What we handle most often

  • Divorce by joint request, with an agreement covering all ancillary effects.
  • Marital protection measures where the separation is contentious.
  • Shared custody, contact rights and one parent relocating with the child.
  • Calculating and varying maintenance for the child and for the spouse.
  • Winding up the matrimonial property regime and splitting occupational pension assets.

How we work

  1. Understanding the figures

We draw up both household budgets using the extended subsistence-minimum method applied by the Federal Supreme Court. That grid decides the outcome, not impressions.

  2. Looking for an agreement

A divorce by joint request costs a fraction of contested proceedings and is settled in a few months. We draft the agreement and go through it line by line.

  3. Keeping the child out of the conflict

We avoid needlessly harsh submissions. What is written during proceedings is read again years later, often by the children themselves.

Frequently asked questions

How long does a divorce take in the canton of Vaud?
By joint request with a complete agreement, allow three to six months between filing and judgment. Where custody or maintenance is disputed, two to three years is not unusual.
We were not married: am I entitled to anything?
There is no maintenance between cohabiting partners, but the child is entitled to it on the same terms as the child of a married couple. Assets acquired together are divided under the rules on simple partnerships, which means proving who paid for what.
